Homeschool Buy Restricted Items Policy
www.HomeschoolBuy.com (“Homeschool Buy” or ”Website”) is owned and operated by its parent company, The Old Schoolhouse Magazine, LLC (“TOS”). For purposes of the Homeschool Buy Restricted Item Policy (“Restricted Item Policy”), “User” means and includes any person or entity accessing or using Homeschool Buy. The Restricted Item Policy applies to all Users and to all auctions, offers, listings and sales (“Listings”) and all items or services (“Items”) posted, offered, sold or Listed on Homeschool Buy. The Restricted Item Policy is part of and incorporated into the Homeschool Buy User Agreement (“User Agreement”). Use of Homeschool Buy constitutes a representation, warranty and agreement that the User has read, understands and agrees to be bound by all portions of the User Agreement.
Restricted Items Part 1: General Rules Governing Restricted and Prohibited Items
RI 1.01 Restricted and Prohibited Items. Homeschool Buy and TOS have implemented the Restricted Item Policy to explain the general rules governing certain types of items and services (“Items”) which (a) cannot be Listed, offered, sold or transferred (collectively, “Listed”) on or through Homeschool Buy (“Prohibited Items”) or (b) may be Listed on or through Homeschool Buy subject to specific rules or limitations. No Item may be Listed on Homeschool Buy which cannot be legally sold over the Internet or shipped through the United States mail or by licensed commercial carriers. The Restricted Items Policy applies only to Homeschool Buy and does not apply to any person, entity, organization, or website to or from which Homeschool Buy links or is linked, including without limitation other websites owned and operated by TOS. Defined terms used but not defined in the Restricted Items Policy have the meanings given elsewhere in the User Agreement.
RI 1.02 Applicable Law, Acceptance of Risk. Applicable laws and regulations may vary depending upon the nature of Restricted Items and the jurisdiction in which the Seller and Buyer work or reside, as well as a variety of other factors. Homeschool Buy does not represent, warrant or guarantee that the Restricted Item Policy completely or accurately states the laws, rules and regulations applicable to any or all Items and accepts no liability or responsibility for any claim, loss or other damage resulting from any User’s knowledge or lack of knowledge of or failure to comply with applicable laws and regulations (collectively, “applicable law”). Users accept full liability and responsibility for knowing and complying with applicable law, as well as full liability and responsibility for the consequences of failure to comply with applicable law. Homeschool Buy and TOS strongly recommend that Users contact an attorney if they have any questions about the legality of, or applicable laws which may impact, a given Listing or transaction.
RI 1.03 Changes to Restricted Items Policy. Homeschool Buy and TOS reserve the sole, discretionary right, but have no obligation, to review, consider and evaluate the extent and character of Restricted or Prohibited Items, to add Items to the lists of Restricted or Prohibited Items and to permit the sale of formerly Restricted or Prohibited Items, subject to applicable laws.
Restricted Items Part 2: Restricted Items
RI 2.01 Restricted Items Generally. Restricted Items may be Listed on Homeschool Buy subject to the specific rules or limitations set forth in the User Agreement and applicable law. Users must comply with these limitations whether or not similar limitations are mandated by laws or regulations applicable in the User’s jurisdiction. Users must also comply with any additional laws or regulations applicable to or in the User’s jurisdiction, even if compliance with applicable law means the User may no longer List, bid on or purchase a given Item.
RI 2.02 Animal Products. Users may not List Items made from protected animals, including threatened and endangered species. “Items made from protected animals” includes all Items and all animals to the extent applicable law restricts or forbids the commercial sale of goods made from parts or pieces of those animals. Permitted animal products include only common, non-perishable Items made from non-protected species, such as wool sweaters and rugs.
RI 2.03 Autographs and Autographed Items. Authentic autographs and autographed Items may be Listed on Homeschool Buy only if accompanied by appropriate, accurate certificates of authenticity. Forged, counterfeit, fake or “reproduced” autographs and autographed Items may not be Listed on Homeschool Buy. Users are strongly cautioned that (a) certificates of authenticity may be prepared by a variety of sources and may or may not actually provide accurate verification of the nature or veracity of an Item or a Listing claim and (b) Homeschool Buy and TOS do not guarantee, and accept no liability for, the nature or veracity of any User or Listed Item. Users should evaluate the reputation of all Sellers and claims made in the relevant Listing prior to bidding on or purchasing any Listed Item.
RI 2.04 Celebrity Photos and Celebrity Items. Photographs and images of celebrities and other famous people (collectively, “Celebrities”) may be protected by applicable law, including without limitation intellectual property law and laws governing individual publicity and privacy rights. Items belonging to or otherwise connected with Celebrities may also be protected by applicable law. Celebrity photographs, images and other Items belonging or related to Celebrities may be Listed on Homeschool Buy only if the Seller has the legal right to sell the relevant Item without infringing the intellectual property, privacy or other legal rights of the relevant Celebrity or any third party.
RI 2.05 Computer Software. Computer software is protected by copyright and other laws. A wide variety of private licenses and policies also govern the sale, resale and transfer computer software. Users wishing to List or purchase computer software on Homeschool Buy must make certain that the relevant software license permits the User to List, sell, transfer and use the software as desired or intended, and may not List, purchase, transfer or use computer software in violation of applicable law and license agreements. Popular software is often sold to teachers, students and educational institutions, or to the purchasers of new computer systems, at discounted prices subject to license agreements which severely restrict or prohibit resale. Users who do not know whether licenses or applicable laws permit the Listing, sale or purchase of specific software should contact the software manufacturer.
RI 2.06 Coupons. Original, valid, manufacturers’ coupons may be Listed on Homeschool Buy, provided that all Listed Items must be: (a) original, valid coupons issued by the original manufacturer or issuer, and may not be expired or duplicated, (b) redeemable by the Buyer on the terms stated on the original coupons, (c) accompanied by clear, accurate Item descriptions which state the expiration date of the coupons and all other terms applicable to redemption of the coupons, (d) physical coupons capable of delivery to the Buyer using the United States mail or similar carrier (Sellers may not List electronic or downloadable coupons), (e) offering no more than two (2) “free item” coupons per Listing and no more than fifty (50) total coupons per Listing. Bulk coupon Listings (defined as Listings offering more than fifty (50) total coupons in a single Listing) are not permitted at Homeschool Buy.
RI 2.07 Downloadable Information and Media. Downloadable information, media and other Items, including without limitation Items existing in digital or electronic formats, may be Listed on Homeschool Buy provided they comply with all of the following:
(a) The Listing Seller must either be the owner, copyright holder or licensed distributor of the Listed Items and must possess the full legal right to List and transfer the Items on Homeschool Buy.
(b) Listed Items must comply with all portions of the User Agreement, including without limitation the Restricted and Prohibited Items Policy, and must be properly Listed and transferred in accordance with applicable law.
(c) Listed Items may not include or incorporate software or code which harms or compromises the security of the Buyer’s computer or personal information (e.g.: computer viruses, key-logging programs or Trojan horse programs)
RI 2.08 Electronics (Restricted). Some electronic Items may be freely Listed at Homeschool Buy, while others are restricted or prohibited. Users must carefully review Restricted Items (RI) Rules 2.08 and 3.15, the User Agreement and applicable law prior to Listing electronic Items on Homeschool Buy. Users may List electronic Items to the extent permitted by the User Agreement and applicable law, including without limitation regulations established by the Federal Communications Commission (FCC). Users are responsible for reviewing applicable law and determining whether or not Items may be properly Listed on Homeschool Buy. The following Items are subject to specified restrictions:
(a) Cordless and wireless telephones may be Listed on Homeschool Buy to the extent permitted by and in accordance with the User Agreement and applicable law. Cordless telephones must comply with FCC regulations and guidelines, and must display FCC identification numbers and compliance labels. Mobile or wireless telephones may be Listed in accordance with RI 2.13, the User Agreement and applicable law.
(b) Radio transmitting devices and related equipment which transmits radio signals, including without limitation devices which transmit on the AM, FM and high frequency amateur radio spectrum, may be Listed on Homeschool Buy to the extent permitted by and compliant with Federal Communications Commission (FCC) regulations and applicable law. Items which interfere with frequency bands allotted to emergency services and governmental entities may not be Listed on Homeschool Buy.
(c) Scanning receivers and radios may be listed on Homeschool Buy unless the relevant device receives cellular transmissions, has "800mz" coverage or otherwise violates applicable law.
RI 2.09 Food and Perishable Items. Food and perishable Items may be Listed on Homeschool Buy, provided that all Listings, Listed Items and transactions comply with the User Agreement and applicable law, including without limitation regulations established by the United States Food and Drug Administration (FDA) and other applicable laws relating to the production, packaging and sale of food and perishable Items. Sellers are responsible for investigating and complying with applicable laws, including without limitation import and export laws. Sellers must possess appropriate food manufacturing, distribution and/or sales licenses as and where appropriate. Listed Items must be packaged and delivered in sealed packaging which ensures Buyers can identify evidence of potential tampering and contains clearly marked expiration dates. Item labels must comply with applicable packaging laws, including without limitation the use of labels containing appropriate ingredient, nutrition and manufacturing information. Listings for perishable Items must clearly state how Sellers will ensure that Items are delivered to Buyers in safe, unspoiled condition. Food and perishable Items may not be sold or delivered to Buyers living in jurisdictions which prohibit or restrict the import of those Items. Item descriptions must state whether an Item cannot be shipped to certain jurisdictions and identify jurisdictions which prohibit or restrict sale, import or export of the Listed Item. Notwithstanding anything in the User Agreement to the contrary, the following food and perishable Items may not be Listed on Homeschool Buy: (a) drugs, dietary supplements and other Items which either make health-related claims or claim to be effective in the prevention, diagnosis, treatment or cure of illness or disease in humans and/or animals, (b) expired Items or Items which cannot be received by Buyers prior to relevant expiration dates, (c) non-pasteurized juice and dairy products, and (d) wild fungi (including without limitation truffles and mushrooms), roots and tubers.
RI 2.10 Gift Cards and Prepaid Cards. Gift cards having a face value of Five Hundred Dollars ($500.00) or less may be Listed on Homeschool Buy, provided that (a) Sellers must have gift cards in hand at the time of Listing and sale, (b) Sellers may List no more than one (1) gift card per week, and (c) Listed gift cards must be offered by authorized Sellers acting in compliance with the User Agreement and applicable law.
RI 2.11 Items Subject to Contractual Obligations. Some Items are subject to pre-existing contractual obligations. Breach (violation) of contract is a serious issue which may result in significant legal liability. Users may not List any Item on Homeschool Buy unless both the Listing and the contemplated transaction (a) comply with all pre-existing contractual obligations and (b) will not violate the contract or other legal rights of any person or entity. Homeschool Buy and TOS do not search for Listings or Items which may raise or involve contract issues. Homeschool Buy and TOS do not and will not review private contracts, provide opinions about the legality of a Listing or proposed transaction, or negotiate private contract disputes.
RI 2.12 Medical Devices and Equipment. Medical devices and equipment may be Listed by authorized sellers or resellers in possession of all necessary or applicable licenses and authorizations and in compliance with applicable law. Sellers may not List medical devices or equipment if government authorization or licensing is required for sale or distribution to third parties. Users are strongly cautioned that the Listing, sale and transfer of medical devices and equipment is highly regulated in some jurisdictions and that Users bear sole liability and responsibility for ensuring that Listings and transactions comply with applicable law.
RI 2.13 Mobile/Wireless Telephones and Mobile Phone Service Contracts. Mobile or wireless telephones (collectively, “mobile phones”) may be sold on Homeschool Buy to the extent permitted by applicable law and pre-existing contracts. Sellers may not List mobile phones on Homeschool Buy if doing so would violate applicable law or any pre-existing contract. For example, a private individual may not attempt to “sell” space on the Seller’s existing “family plan” contract if the terms of the Listing and eventual sale would violate the terms of the “family plan” contract. Mobile phone service contracts may be Listed alone or bundled with a mobile phone, to the extent permitted by applicable law and pre-existing contracts. Mobile phone service contracts may be Listed in accordance with the following terms: (a) Listing Sellers must be authorized sellers or resellers of mobile phone services, (b) Listings must offer a full refund to any Buyer who is rejected or otherwise fails to qualify for a service contract, (c) Listings must clearly state the jurisdictions, states or zip codes within which plans are applicable, operative and serviced and must state, in detail, restrictions and limitations placed on the service or contract along with any qualifications the Buyer must meet to purchase and qualify for the contract, and (d) Sellers and Listings must comply with applicable law in all jurisdictions relevant to the Listing, sale and contract, including without limitation the state of California and the states of residence of both the Seller and the Buyer.
RI 2.14 Movies and Films. Movies, films and prints of movies and films contained on 35mm or 70mm film (the size and nature of reels used by movie theatres) may be Listed by the copyright owner of the original movie or the authorized licensee of the original copyright owner. Sellers Listing or attempting to List movie prints in this format must be able to document their status as the copyright holder or authorized licensee of the copyright holder to the satisfaction of Homeschool Buy and TOS.
RI 2.15 Plants, Seeds and Biological Material. Some jurisdictions prohibit or heavily regulate the sale, import and possession of plants, seeds and biological material. Plants and seeds may be sold on Homeschool Buy provided (a) Listings clearly and specifically identify the jurisdictions in which and to which the Listed Items may (or may not) be sold or shipped, and (b) Sellers, Buyers and transactions comply with all applicable laws, including without limitation licensing and shipping laws.
RI 2.16 Political Items and Memorabilia. The sale of political memorabilia is regulated by the federal laws of the United States, which require (among other restrictions) that reproductions of political memorabilia contain clear, legible markings identifying the date the Items were manufactured. Federal laws also contain other restrictions designed to prevent fraud and protect purchasers and collectors of various collectables and memorabilia. Political Items and memorabilia may be Listed at Homeschool Buy provided Sellers ensure that all Listings, Listed Items and transactions comply with applicable law.
RI 2.17 Promotional Items. Promotional Items, including without limitation “advance” or promotional copies of books and other copyrighted works, may be Listed on Homeschool Buy to the extent permitted by and in accordance with the User Agreement and applicable law.
RI 2.18 Replicas and Reproductions. Replicas and reproductions of Items may be Listed on Homeschool Buy to the extent permitted by the User Agreement and applicable law, provided the relevant Listing, and where required by law a mark on the Item itself, clearly and unequivocally identifies the Item as a replica or reproduction. Certain types of replicas and reproductions, most notably counterfeit currency, are restricted or prohibited by applicable law. Counterfeit Items and Items which are prohibited by applicable law may not be Listed on Homeschool Buy.
RI 2.19 Tickets and Vouchers. The private sale of tickets and vouchers is heavily regulated by law in most jurisdictions. Users are specifically cautioned that many states restrict or prohibit the sale of event tickets and that tickets purchased from private sellers may be subject to laws regulating ticket “scalping.” Users may not List tickets or vouchers on Homeschool Buy unless the Listing and terms of sale or transfer comply with all applicable laws and contractual obligations. Users are strongly encouraged to consult with an attorney prior to Listing tickets on Homeschool Buy.
RI 2.20 Travel. Users are strongly cautioned that travel and the provision and sale of travel related services are heavily regulated industries. Individuals who violate applicable laws may be subject to serious legal and financial penalties. Travel and travel-related services may be Listed on Homeschool Buy by licensed businesses and individuals in the active business of providing travel services to third parties subject to the User Agreement and applicable law, including without limitation all regulations and laws governing the sale of travel or travel-related services. Private, unlicensed individuals may not List travel services, tickets or other travel related products on Homeschool Buy under any circumstances. Travel and travel-related listings must (a) contain clear language identifying the Seller as a travel agent or licensed travel provider, (b) verify that the listings or travel offered will be booked by the Seller personally and not by any third party or affiliate, (c) truthfully state that no additional fees, charges or after sale purchase requirements will apply to booking or paying for the travel or travel-related services associated with the Listing and (d) provide any other legally required information, including without limitation license numbers and professional identifications where appropriate. Travel and travel-related Items may not be Listed on Homeschool Buy if the Listing or contemplated transaction would violate any applicable law. Users are strongly encouraged to consult with an attorney prior to Listing travel or travel-related services on Homeschool Buy.
Restricted Items Part 3: Prohibited Items
RI 3.01 Prohibited Items Generally. Prohibited Items may not be Listed on Homeschool Buy. Items may be characterized as Prohibited Items for a variety of reasons, some of which include federal and state laws and regulations restricting the ownership, purchase and sale of certain Items.
RI 3.02 “Adult,” Obscene and Pornographic Items. Items which are “adult” in nature or inappropriate for use by children under the age of eighteen (18) may not be Listed on Homeschool Buy. Pornography and obscene Items may never be Listed at Homeschool Buy. While many of these Items may be legally used, possessed and sold throughout the United States, Homeschool Buy is committed to providing a family-friendly Internet website and does not permit the Listing, advertisement, sale or discussion of such Items. Mainstream media, video games, books and movies with ratings of “X” or “AO” (Adults Only), as appropriate, are not permitted at Homeschool Buy, but Items with ratings of “R” or indicating a parental advisory notice falling short of “Adults Only” are permitted. Homeschool Buy and TOS reserve the sole, discretionary right to permit or prohibit Items rated “NC-17” on an Item by Item basis. Nudity is not permitted, except where the nudity in question is part of a larger educational or artistic work containing representations of classical statues such as Michaelangelo’s “David” or similar artistic works. Items which contain profanity in their titles, or which cannot be accurately described without the use of profanity or alternative characters replacing profanity, may not be Listed at Homeschool Buy.
RI 3.03 Alcoholic Beverages. Alcoholic beverages may not be Listed on Homeschool Buy.
RI 3.04 Animals. Live animals may not be Listed on Homeschool Buy.
RI 3.05 Artifacts, Remains and Ancient Objects. Artifacts, ancient human or animal remains and ancient objects are protected by a variety of federal, state and local laws, including without limitation the Native American Grave Protection and Repatriation Act. Users may not List, sell or transfer Items on Homeschool Buy if those Items are subject to transfer restrictions, licensing or other regulation under the Native American Grave Protection and Repatriation Act or other applicable law regulating the registration and sale of artifacts, remains or ancient objects.
RI 3.06 Beta and Other Prerelease Software. Copies of “beta” or other pre-release versions of software are generally prohibited and may not generally be Listed on Homeschool Buy. Software manufacturers may List beta or pre-release versions of their own software, provided (a) the Listing Seller is the copyright owner and manufacturer of the software and has the full legal authority to List, sell and transfer the software in its offered condition, (b) the Listing clearly identifies the software as “beta” or pre-release and (c) the Listing contains sufficient information for Users unfamiliar with computers and software to understand that the Listed Item is a pre-release version of computer software and to appropriately understand and evaluate the risks inherent in purchasing and using the pre-released software.
RI 3.07 Bootleg Recordings. “Bootleg” or “pirated” recordings are private, unauthorized audio or video recordings of concerts or other live performances and events. Bootleg recordings violate applicable law and may not be Listed on Homeschool Buy.
RI 3.08 Catalogs. Catalogs may not be Listed on Homeschool Buy. Catalog Listings permit Users to sell catalogs at very low prices with the intent of completing catalog-based sales outside of Homeschool Buy and are a form of prohibited fee avoidance. Old or collectible catalogs from which buyers may no longer place orders may be Listed with the express, advance permission of Homeschool Buy, which may be granted or withheld at the sole discretion of Homeschool Buy and TOS. For example, a User who wished to List a collectible catalog may contact Homeschool Buy to determine whether the catalog may be Listed, but may not List the catalog until and unless Homeschool Buy grants the User written permission to do so. Homeschool Buy will not grant permission to List current catalogs.
RI 3.09 Catalytic Converters, Test Pipes and Other Restricted Automotive Items. The United States government restricts the private sale of certain catalytic converters, test pipes and other automotive and auto-related Items. Users must consult applicable law prior to Listing automotive Items on Homeschool Buy and may not List Items in violation of applicable law.
RI 3.10 Child Safety Seats. Car seats and child safety seats may not be Listed on Homeschool Buy.
RI 3.11 Clothing and Cosmetics. New clothing may be Listed on Homeschool Buy. Used clothing may be Listed on Homeschool Buy with the exception of used underwear or athletic supporters, which may not be Listed on Homeschool Buy. New, unopened cosmetics may be Listed, but opened or used cosmetics may not be Listed on Homeschool Buy.
RI 3.12 Credit and Debit Cards. Credit and debit cards may not be Listed on Homeschool Buy.
RI 3.13 Counterfeit Items. Counterfeit, forged, “fake” or unauthorized Items (collectively “Counterfeit Items”) may not be Listed on Homeschool Buy. The term “Counterfeit Items” includes without limitation unauthorized copies of any and all Items protected by intellectual property laws, including without limitation software, DVDs, CDs, video games, television programs, music albums and photographs. Machinery, hardware and software used to make counterfeit and replicated Items is also prohibited on Homeschool Buy, with the exception of photocopiers, VHS recorders and other legally permitted devices which have the production of legally permitted archival copies as their primary function or purpose.
RI 3.14 Drugs, Supplements, Pharmaceuticals and Paraphernalia. Drugs (prescription or non-prescription), dietary or health-related supplements or pharmaceutical products may not be Listed on Homeschool Buy, whether or not classified as drugs by the United States Food and Drug Administration and whether or not restricted in the United States. Illegal controlled substances and substances which produce the same effect as illegal substances when ingested, inhaled or used may not be Listed on Homeschool Buy. Drug paraphernalia and Items used in the manufacture and use of legal or illegal drugs, supplements and pharmaceutical products may not be Listed on Homeschool Buy.
RI 3.15 Electronics (Prohibited). Some electronic Items may be freely Listed at Homeschool Buy, while others are restricted or prohibited. Users must carefully review Restricted Items (RI) Rules 2.08 and 3.15, the User Agreement and applicable law prior to Listing electronic Items on Homeschool Buy. Users may not List electronic Items prohibited or outlawed by the Federal Communications Commission (FCC) or other applicable law. Prohibited Items include, without limitation:
(a) Cable television and satellite transmission descramblers and other Items designed to provide unauthorized access to cable television or satellite transmission signals.
(b) Items designed to reset, lower, modify or calibrate the mileage shown on motor vehicle odometers.
(c) Items which claim or have as their primary purpose the ability to jam, scramble or otherwise interfere with law enforcement radar or laser devices.
(d) Items which claim or have the ability to change or inhibit the natural pattern and function of traffic signals
(e) Power amplifiers designed for use with or to boost the radio signals of Citizens’ Band (CB) radios or similar radio frequencies.
(f) Radar detectors.
RI 3.16 Firearms, Weapons and Related Items. Although Homeschool Buy supports the rights of private individuals to possess, transfer and sell a variety of legally permitted, licensed weapons, the possession, sale and transfer of weapons is highly regulated by federal, state and local laws. Firearms, weapons and related Items may not be Listed on Homeschool Buy at this time.
RI 3.17 Gambling Devices (Including Slot Machines). Gambling and gambling devices (including slot machines) are heavily regulated throughout the United States. Some jurisdictions have laws making it illegal to possess or sell gambling devices without special licenses. As a general rule, gambling devices may not be Listed at Homeschool Buy. Slot machines which were not manufactured to and cannot accept coins or tokens and non-functional machines produced exclusively for decorative or display purposes may be Listed at Homeschool Buy. Slot machines which have been permanently altered and will no longer accept any coin or token may also be Listed at Homeschool Buy, provided the machines have been altered in a manner which prevents a Buyer or other third party from subsequently modifying or “repairing” the machine to enable it to once again function as a coin-operated slot machine.
RI 3.18 Government, Military and Law Enforcement IDs, Uniforms and Other Official Items. For purposes of the User Agreement, “government, military and law enforcement” means all forms and branches of federal, state, local and international government, law enforcement (e.g.: police, fire department) and military forces (e.g.: army, air force). Government, military and law enforcement identification cards, badges, uniforms and other official symbols may not be Listed on Homeschool Buy. Postage meters may not be Listed on Homeschool Buy. Internal, non-public documents, manuals and similar materials produced by government, military and law enforcement agencies may not be Listed on Homeschool Buy. Properly Listed flags and banners are not considered official symbols for purposes of this RI 3.18.
RI 3.19 Hazardous Materials and Dangerous Items. Hazardous materials (as defined by the federal, state and local laws of the United States) and Items which may pose a significant danger to health, safety or property during transportation and proper use (e.g.: explosives), may not be Listed on Homeschool Buy. No Item may be Listed on Homeschool Buy which cannot be legally shipped through the United States mail or by licensed commercial carriers.
RI 3.20 Human Beings, Body Parts and Remains. Living and dead human beings, human body parts and Items made from human body parts may not be Listed on Homeschool Buy, with the exception of wigs and other legal Items made from human hair. Item descriptions must clearly state that relevant Items are made from human hair.
RI 3.21 Illegal and Inappropriate Items. Homeschool Buy prohibits the Listing, sale and transfer of any and all Items which cannot be legally possessed, Listed, transferred, sold or shipped to Buyers under applicable law. Stolen Items may not be Listed at Homeschool Buy. Items which (a) promote or glorify hatred and violence (e.g.: Nazi propaganda), (b) promote, encourage, solicit or glorify illegal acts (e.g.: Items which promote the use of marijuana as a recreational drug), (c) contain racial or ethnic slurs, (d) attempt to profit from criminal acts or criminal notoriety of the Seller, or (e) glorify or attempt to profit from natural disasters or tragic events (e.g.: photographs of airplane crashes or natural disasters) may not be Listed at Homeschool Buy. Exceptions may be made for Items which depict natural disasters or tragic events and contain independent artistic, political or social value (e.g.: patriotic images which contain appropriate references to the 9/11 attacks on the World Trade Center). Homeschool Buy and TOS reserve the sole, discretionary right, but not the obligation, to determine whether Listings feature, offer or include illegal, offensive or non-permitted Items and to end or remove such Listings. Sellers are not entitled to returns or refunded fees for Listings terminated for violation of the User Agreement.
RI 3.22 Illegally Imported Goods, Embargoed Goods. U.S. laws ban or substantially regulate the import of Items from certain countries, including without limitation Cuba, Iran, Libya and North Korea, along with Items purchased from certain individuals and entities. Users may not List Items from these countries, individuals or entities on Homeschool Buy. For example, a box of Cuban cigars may not be Listed on Homeschool Buy.
RI 3.23 Infringing (Circumvention) Technologies. Hardware, software and other technologies which enable Users to make unauthorized copies of protected intellectual property (e.g.: “ripping” software for copying video games or CDs) may not be Listed on Homeschool Buy.
RI 3.24 Lockpicking Devices and Thieves’ Tools. Lockpicking and locksmithing devices may not be Listed on Homeschool Buy. Thieves’ tools may not be Listed on Homeschool Buy.
RI 3.25 Lottery and Raffle Tickets. Lottery and raffle tickets may not be Listed on Homeschool Buy.
RI 3.26 Mailing and Customer Lists. Mailing, email, Internet Protocol (IP), Instant Messenger (IM) and other addresses may not be Listed on Homeschool Buy. Mailing or customer lists containing names, addresses, telephone numbers or other personal identifying information may not be Listed on Homeschool Buy. Tools, machines, programs or software designed to harvest or collect personal information or addresses or to send unsolicited commercial messages may not be Listed at Homeschool Buy.
RI 3.27 “Mod Chips” and Modified Game Systems. Modification or “mod” chips, boot discs and modified game systems enable domestic video game consoles to play imported versions of video games. These chips, discs and systems may not be Listed on Homeschool Buy.
RI 3.28 Poisons and Pesticides. Poisons and pesticides may not be Listed on Homeschool Buy.
RI 3.29 Public Transportation IDs, Uniforms and Related Items. Identification cards, badges, uniforms and official symbols used by or related to airlines and other entities responsible for providing commercial public transportation (e.g.: uniforms worn by city bus drivers) may not be Listed on Homeschool Buy.
RI 3.30 Real Property and Real Estate. Real estate and the Listing and sale of real property are heavily regulated by a variety of laws, including without limitation laws relating to the licensing and supervision of real estate agents, laws regulating advertising and laws regulating the sale of land, houses and other real property assets. Real property and real estate may not be Listed on Homeschool Buy at the present time.
RI 3.31 Recalled Items. The United States Consumer Products Safety Commission (CPSC) exists to protect consumers against potentially hazardous Items. The CPSC periodically “recalls” Items which present potential health and safety hazards to consumers. Items which have been recalled by the CPSC may not be Listed on Homeschool Buy.
RI 3.32 Securities and Stocks. Securities and stocks may not be Listed on Homeschool Buy.
RI 3.33 Surveillance Equipment. Surveillance equipment, which means and includes Items designed or intended to record the conversations or actions of other persons without their knowledge or permission, may not be Listed on Homeschool Buy.
RI 3.34 Tobacco. Tobacco products and advertisements or coupons for tobacco products may not be Listed on Homeschool Buy.
