Homeschool Buy SPAM and Unsolicited Contact Policy
www.HomeschoolBuy.com (“Homeschool Buy” or ”Website”) is owned and operated by its parent company, The Old Schoolhouse Magazine, LLC (“TOS”). Homeschool Buy and TOS are strongly committed to protecting personal privacy. For purposes of this Homeschool Buy SPAM and Unsolicited Contact Policy (“Spam Policy”), “User” means and includes any person or entity accessing or using Homeschool Buy. This Spam Policy is part of and incorporated into the Homeschool Buy User Agreement (“User Agreement”). Use of Homeschool Buy constitutes a representation, warranty and agreement that the User has read, understands and agrees to be bound by all portions of the User Agreement.
SP 1. Purpose and Applicability. This Spam Policy is incorporated into and subject to the provisions of the User Agreement. Homeschool Buy and TOS have implemented this Spam Policy to further explain the position and policies applicable to unsolicited contacts and non-permitted use of personal and financial information gathered from and about Users (“Personal Information”). This Spam Policy applies only to Homeschool Buy and does not apply to any person, entity, organization, or website to or from which Homeschool Buy links or is linked, including without limitation other websites owned and operated by TOS. Other websites may contain similar or different policies relating to Spam and unsolicited contact. Users are strongly encouraged to regularly read and review posted policies on all websites, whether or not owned by TOS or affiliated with Homeschool Buy.
SP 2. SPAM. “Spam” is unsolicited commercial e-mail. Spam is illegal in many jurisdictions and strictly regulated by applicable laws in many other jurisdictions. The federal laws of the United States, including without limitation the CAN-SPAM (Controlling the Assault of Non-Solicited Pornography and Marketing Act) Act of 2003, place strict limitations on unsolicited commercial e-mail. Users should never send Spam to any person or entity. Homeschool Buy and TOS strictly prohibit Spam and other forms of unsolicited communication and unwanted contact.
SP 3. Spoofing. “Spoofing” means creating or using a fake, fraudulent or unauthorized name, website or e-mail address in order to make communications appear to originate from a different source. Common spoofing techniques include misspellings and close spellings of actual company URLs or e-mail addresses. For example, a website having the URL http://www.homescholbuy.com or an e-mail originating from Service@homescholbuy.com could be Spoofing Homeschool Buy. Spoofing is often used by individuals seeking to wrongfully obtain Personal Information from Users and third parties. Spoofers then use this information to engage in further illegal activities, including fraud and identity theft. Users who suspect Spoofing in e-mail or other communications should contact the Spoofed company or individual immediately using alternative, trusted means of communication. Do not provide anyone with Personal Information before confirming the nature and source of the request. Homeschool Buy and TOS will never ask Users to reveal, confirm or disclose login names, passwords or financial information via e-mail.
SP 4. Phishing. “Phishing” means attempting to obtain Personal Information through fraudulent means, frequently including Spoofing. Phishing is illegal. Phishers often attempt to acquire sensitive Personal Information by pretending to be representatives of banks, websites or other trusted sources and institutions. Common Phishing techniques include e-mail or telephone calls requesting that the recipient “verify” personal contact and credit card information. If obtained, this information may be used for a variety of illegal purposes including identity theft. Homeschool Buy and TOS will never ask Users to reveal, confirm or disclose login names, passwords or financial information via e-mail. Users who receive e-mail or other unsolicited contacts which appear to be attempts at Phishing should contact the Spoofed company immediately using alternative, trusted means of communication and should not provide anyone with Personal Information before confirming the nature and source of the request. Users should not rely upon the presence of Personal Information in e-mail or other contact as a sign of reliability.
SP 5. Other Non-Permitted Contact. Homeschool Buy and TOS prohibit the use of Homeschool Buy, Personal Information gathered from Homeschool Buy and information acquired as a result of transactions taking place on or through Homeschool Buy for purposes of unsolicited communication and contact to, from, by and with Users and third parties. This includes certain communications and contacts which may not otherwise qualify as illegal Spam. No User or third party may harvest or collect information from Homeschool Buy for any purpose unrelated to legitimate transactions carried out on Homeschool Buy. No User or third party may use information gathered, provided or otherwise acquired from, through or using Homeschool Buy or TOS for contacts or communications which contain: (a) Spam, (b) Phishing or Spoofing, (c) offers or solicitations to buy or sell Items outside of Homeschool Buy, (d) threats, insults or racial slurs, (e) profanity, obscenity, nudity or sexually explicit or suggestive material, images and content, or (f) any other fraudulent or illegal information or content.
SP 6. Reporting Unwanted Contact. Users may take several actions in response to unwanted or illegal e-mail and other communications, only some of which are mentioned here. Users may set e-mail preferences or “rules” in private e-mail programs in order to block communications from unwanted senders or e-mail addresses. Most commercial e-mail also provides recipients with an “opt-out” feature permitting the recipient to halt future communications from the sender. Unwanted e-mail may be forwarded or referred to the sender’s Internet Service Provider (ISP) or to UCE@FTC.gov – an address established by the United States government to receive reports of illegal Spam.
SP 7. Contact by Homeschool Buy and TOS. Registration for a User account at Homeschool Buy constitutes permission for Homeschool Buy and TOS to contact the User for various purposes, including without limitation surveys, promotional messages and information about new offers and services available through Homeschool Buy and TOS. If you would rather not receive these messages, you should use the “opt-out” option available on each type of e-mail. Users should be aware that different types of communications fall within different “opt-out” provisions, and that a single opt-out notice will not terminate all communications from Homeschool Buy and TOS.
SP 8. Proper Use of Information. Use of Homeschool Buy constitutes each User’s express representation, warranty and agreement that (a) User will disclose identifying personal and financial information to Homeschool Buy, TOS and other Users as reasonably necessary to complete and carry out permitted transactions or properly use services provided on and through Homeschool Buy, (b) User will use information relating to or provided by other Users only for purposes of engaging in permitted transactions and properly using services provided on and through Homeschool Buy, and (c) User grants other Users, Homeschool Buy and TOS permission to use reasonably necessary portions of User’s Personal Information for purposes of engaging in permitted transactions and properly using services provided on and through Homeschool Buy. Users may need to share additional personal and financial information with one another in order to complete and carry out permitted transactions or to properly utilize services provided on and through Homeschool Buy. Homeschool Buy and TOS strongly caution Users to be careful about disclosing any information to any person or entity, to protect confidential information and to respect the privacy of other Users and third parties. Homeschool Buy and TOS cannot and do not guarantee the safety or confidentiality of information posted on the Internet or provided to other Users or third parties.
SP 9. Privacy Rights. Personal Information, Financial Information and other information provided to, posted on, incorporated into or stored on behalf of Homeschool Buy may be subject to a variety of legal rights, including without limitation privacy and publicity rights. Use of information appearing on Homeschool Buy is subject to the User Agreement and applicable law. Use of information without the permission of the legal owner may result in liability for a variety of claims, including without limitation violation of privacy rights. No person or entity may use or commercially exploit the rights of any individual or entity without the consent of the subject except as permitted by the User Agreement or applicable law.
